Ofer Cassif is a political philosopher (PhD, London School of Economics) from Rehovot and a leader of the Communist Party of Israel, the core of Hadash, who has been the Jewish MK on Hadash's lists since 2019. He was jailed four times as a conscientious objector during the First Intifada. He has been repeatedly sanctioned by the Knesset Ethics Committee, and a 2024 attempt to expel him from the Knesset over his support for South Africa's ICJ case failed. The Central Elections Committee disqualified him again on 23 September 2026 on a Likud motion, but on 2 October 2026 the Supreme Court overturned the ban 7–2 (Justices Mintz and Stein dissenting).

תקציר הכרעת הדין: בית משפט השלום הרשיע היום, בהכרעת דין מנומקת ומפורטת, מפי כבוד השופט ביאלין אלעזר, את הנאשם, חבר הכנסת עופר כסיף, בעבירה של תקיפת שוטר בנסיבות מחמירות, לפי סעיף 274(1) לחוק העונשין, התשל"ז-1977. על פי כתב האישום, ביום 13.5.22, במהלך אירועי מחאה באזור דרום הר חברון בעקבות פסק דין של בית המשפט העליון בנוגע לכפרים במרחב 'מאספר יטא', הוצאו צווים שהכריזו על סביבת צומת כביש 317 וצירי העפר המובילים ליטא כאזור צבאי סגור. הנאשם הגיע למקום ברכבו והצטרף לקבוצת מפגינים. סמוך לשעה 12:00, לאחר שכוחות הביטחון עצרו את רכבו של הנאשם על ציר העפר ומנעו ממנו להתקדם במתחם ההפגנה מטעמי בטיחות ואיסור כניסה לשטח A , ניגש הנאשם בעצמו לרכב על מנת לנהג בו. בין הנאשם לקצין משמר הגבול פקד דור אמיתי ולשוטר יצחק אזולאי התפתח ויכוח סוער שכלל קריאות גנאי מצד הנאשם ("שקרן מטונף", "רמאי", "פושע", "חלאות המין האנושי" ו"אפס מאופס"). הנאשם נכנס לרכבו, ולאחר שהשוטר אזולאי עמד בחזית הרכב כדי לחסום את תנועתו, נסע הנאשם מספר מטרים לאחור ואז התקדם בנסיעה איטית לפנים עד שפגע עם הרכב ברגלו השמאלית של השוטר אזולאי, בכוונה להכשילו בתפקידו. בתגובה, הכה השוטר על מכסה המנוע, וכאשר יצא הנאשם מרכבו התפתח עימות מילולי שבמהלכו השוטר הניף את אצבעו ונגע קלות בפניו של הנאשם. בתגובה לכך, הרים הנאשם את ידו הימנית וחבט בחזקה בצד השמאלי של ראש השוטר, באופן שגרם לו לכאבים בראשו וברגלו. הנאשם כפר במיוחס לו, טען לחסינותו הפרלמנטרית המקנה לו לכאורה מעבר חופשי עם רכבו, טען כי פגיעת הרכב הייתה מקרית וכי החבטה בראש השוטר נעשתה מתוך "הגנה עצמית" לאחר שהשוטר תקף אותו לכאורה באצבעו, ואף העלה טענה מקדמית לאכיפה בררנית. בית המשפט דחה מכל וכל את טענות ההגנה. נקבע כי כוחות הביטחון פעלו כדין ובסמכות מלאה משיקולי ביטחון ובטיחות למנוע סיכון חיים וכניסה אסורה לשטח A וכי חסינותו של הנאשם כחבר כנסת מומשה במלואה בכך שהתאפשר לו לנוע ברגלו בחופשיות במתחם ההפגנה, אך אין בה כדי להקנות לו זכות לסכן אנשים או להכשיל שוטרים באמצעות נסיעה ברכב. עוד נקבע כי הוכח מעבר לכל ספק סביר כי הנאשם פגע בשוטר באמצעות רכבו מתוך מודעות וכוונה להכשילו, וכי תגובתו האלימה (החבטה בראש השוטר) אינה חוסה תחת סייג ההגנה העצמית שכן מדובר בתגובה בלתי מידתית בעליל לעומת נגיעה אקראית שנגרמה מתנועת גופו של הנאשם עצמו. לבסוף, נדחתה טענת האכיפה הבררנית לאור הפער הראייתי המובהק והעדר פגם בהתנהלות התביעה.
Translation Summary of the verdict: The Magistrate's Court today, in a reasoned and detailed verdict delivered by Judge Elazar Bialin, convicted the defendant, MK Ofer Cassif, of the offense of assaulting a police officer under aggravated circumstances, under Section 274(1) of the Penal Law, 5737-1977. According to the indictment, on 13.5.22, during protest events in the South Hebron Hills area following a Supreme Court ruling regarding the villages in the 'Masafer Yatta' area, orders were issued declaring the vicinity of the Route 317 junction and the dirt roads leading to Yatta a closed military zone. The defendant arrived at the site in his car and joined a group of protesters. At around 12:00, after the security forces stopped the defendant's car on the dirt road and prevented him from advancing into the protest compound for safety reasons and because of the ban on entering Area A, the defendant himself went to the car in order to drive it. A heated argument developed between the defendant and Border Police officer Inspector Dor Amitai and police officer Yitzhak Azoulay, which included insults by the defendant ("filthy liar", "cheat", "criminal", "scum of the human race" and "absolute zero"). The defendant got into his car, and after officer Azoulay stood in front of the car to block its movement, the defendant drove a few meters backward and then moved forward slowly until he struck officer Azoulay's left leg with the car, with the intention of obstructing him in the performance of his duty. In response, the officer struck the hood, and when the defendant got out of his car a verbal confrontation developed during which the officer waved his finger and lightly touched the defendant's face. In response to this, the defendant raised his right hand and struck the left side of the officer's head hard, in a way that caused him pain in his head and his leg. The defendant denied the charges against him, claimed his parliamentary immunity supposedly grants him free passage with his car, claimed that the car strike was accidental and that the blow to the officer's head was done in "self-defense" after the officer allegedly attacked him with his finger, and even raised a preliminary claim of selective enforcement. The court rejected the defense's claims outright. It was determined that the security forces acted lawfully and with full authority, for reasons of security and safety, to prevent danger to life and forbidden entry into Area A, and that the defendant's immunity as a Knesset member was fully realized in that he was allowed to move freely on foot in the protest compound, but that it does not grant him the right to endanger people or to obstruct police officers by driving a car. It was further determined that it was proven beyond any reasonable doubt that the defendant struck the officer with his car knowingly and with intent to obstruct him, and that his violent response (the blow to the officer's head) is not covered by the self-defense exception, since it was a patently disproportionate response compared to an incidental touch caused by the movement of the defendant's own body. Finally, the claim of selective enforcement was rejected in light of the clear evidentiary gap and the absence of any flaw in the prosecution's conduct.
